When an inmate dies in prison, is the body released to the family or the government takes charge of it?
Ordinarily, the body will be returned to the biological next of kin listed in an inmate’s medical records. If none exist, then a secondary party, also given by the inmate, will be contacted, and offered the opportunity to claim the body. If no one does claim the body, it is cremated by the state.
The deceased inmate’s next of kin is notified once the issue of death happens. Information for that is usually gleaned from either records or the emergency contact data the inmate must have filled out upon in-processing and booking.
If no kin or responsible parties can be found the State will handle the disposal of body process.
