Legally, no two different businesses should share the same logo. Although, there are some businesses that just design their logos from free logo sites, hence logos might look similar. But once a brand trademarks a logo, then finds out there is another business sharing that logo, they can sue such businesses as the logo rightfully belongs to them.
I suppose it depends if it’s in the same country. If it is, the first person to start using the logo may tend to have a upper hand and you will have to either dispute it or change your design if not the foreign company will have to be analysed to see if it infringes on your business. Make your brand logos with professional designers to avoid messy situations like this.
