With the second wave of the covid-19 hitting hard, I believe no one should be forced to use the face mask. It’s simply logical, use a face mask to prevent the spread. Everyone should be mandated to wear a mask

If a local law authority or governor orders a mask mandate and make arrest a consequence of not wearing a mask, then law enforcement has a duty to arrest someone that refuses to wear a mask. If a consequence is not assigned, the penalty is often up in the air which is just confusing all around.
If a local law authority recommends a mask mandate, no one should be arrested. A recommendation is not something law enforcement can enforce.
If a business decides that to make mask a condition to be able to enter their property, you must wear a mask, that is the business’ decision. It’s no different than the business not allowing smoking in their building. If you refuse to wear a mask, the business has every right to not allow you inside and the right to have law enforcement remove you from their property.
In all the videos I’ve seen of people refusing to wear a mask, they are not arrested for not wearing a mask. They are arrested for how they behave when asked to wear a mask. Such as pushing past the store employee when stopped at the door. Screaming at everyone and cussing them out (disturbing the peace.) Sitting on the floor and refusing to leave when asked to wear a mask, it is considered tresspassing if you refuse to leave after being asked to do so.
That sounds so ridiculous— arresting people who refuse to use face masks. If you’re living in a small town and you take your dog for a walk first thing in the morning when there’s no one about , there’s no reason to wear a mask . You can’t give the virus to anyone and no one can give it to you. If you go into a busy shop then there is every reason to wear a mask; the chances of you giving the virus to anyone are greatly reduced, and the chances of you getting it from a mask wearer are greatly reduced . Another problem is where are the huge number of cops coming from who are suddenly going to stop all other police activity and who will be on constant “ no mask wearers “ patrol . A more fundamental approach is to keep the number of people in public to a minimum, to prevent the spread of the virus. So just arresting the no wearers would certainly help if it was practical , but masks on their own are not the answer.
