  1. Depends on what animal, the situation, and the place. In some places some animals are sacred, so they could be easily killed by the faithful. In most places animals are property, so killing it would be a crime against property with fines or jail time. But if the animal in question is a pet, there could also be extra judiciary consequences, such as being beaten or worse
    If a poisonous animal comes in, I will kill it cos it could find its way back if I get it out of the house. If it is just harmless animal like a cat, bird, small insects, I could try my best get them out of the house as carefully as possible.

  2. Unless the animal is threatening you, you should not kill any animal that strays into your house or vicinity. If you want to punish the owner of the animal for allowing it to stray into your house, though, I recommend humanely trapping it and turning it over to the local animal shelter. Let them know you caught it inside your house and that you do not know who it belongs to. Assuming that you are in the US, most areas have laws against allowing animals to roam at large, even cats. Even if they don’t have one that specifically includes a particular animal, most areas have laws against nuisance animals, and entering residences should count for that. The owner will be contacted and fined for the offense. If it happens again, rinse and repeat. The fines generally go up each time the animal is turned over for roaming, and eventually they will no longer release the animal to an owner who has proven they will not keep it contained.
