First, you have to go declare at the bank(if they don’t know yet) that your wife is dead, go with a death certificate. The next thing that would be done is for the bank to turn the account or accounts (if more than one) of your late wife to an estate account. However, before you can gain access to your wife’s account or be in charge, you have to go and get a letter of administration which is going to confirm you as the new administrator of the account. It’s sort of a long process, but it’s something the account office of your late wife can walk you through.
To access accounts, someone needs to go to court in their county and be named administrator of the estate, they receive letters of administration, and they take that and the death certificate to the bank to gain access, but the administrator cannot just do whatever they think is right, they have to follow the law.
You should call a probate or estate attorney to discuss your options. A consultation should be free and if you wind up using their services, such actions could be paid for from the estate rather than out of your pocket.
